These Terms & Conditions (“Terms”) govern your use of nightdunes.com (the “site”) and any purchase you make from it. By using the site or placing an order, you agree to these Terms. Please read them together with our Privacy Policy, Cookie Policy, and Shipping & Returns policy, which are incorporated by reference.
1. Who we are
The site is operated by Night Dunes Inc. (“Night Dunes,” “we,” “us,” “our”), based in Calgary, Alberta, Canada. You can reach us at support@nightdunes.com.
2. Using the site
You may use the site for lawful, personal, non-commercial purposes. You agree not to misuse the site, interfere with its operation, attempt to gain unauthorised access, or use it in any way that breaches applicable law. We may suspend or withdraw access to the site at any time without notice.
To place an order you must be of the age of majority in your province and able to enter into a binding contract.
3. Products, descriptions, and images
We take care to describe and photograph our products accurately. Colours and finishes may appear differently on different screens, and packaging supplied by our manufacturer may vary slightly from images. Product descriptions and ingredient lists reflect the information provided to us by our supplier; if anything appears incorrect, please contact us before ordering.
Cosmetic products. Our products are cosmetics intended for external use as directed. They are not medicines and are not intended to diagnose, treat, cure, or prevent any condition. Always read the label and follow the usage directions, and patch-test if you have sensitive skin. If you experience irritation, discontinue use. If you have a known allergy or a medical concern, consult a professional before use.
4. Prices and payment
All prices are shown in Canadian dollars (CAD) and, unless stated otherwise, exclude applicable taxes and shipping, which are calculated and shown at checkout. We may change prices at any time, but changes do not affect orders we have already accepted.
Payment is taken at the time you place your order, through our payment providers Stripe and PayPal. By submitting an order you confirm that the payment method is yours or that you are authorised to use it.
We make reasonable efforts to ensure pricing is correct. If we discover a genuine pricing or description error after you order, we may cancel the order and refund you in full; we will contact you first where practical.
5. Orders and acceptance
Your order is an offer to buy. A confirmation email acknowledges we have received your order but does not by itself form a contract. The contract is formed when we accept your order by dispatching it. We may decline or cancel an order — for example, if an item is unavailable, if we suspect fraud, or if there has been a pricing error — and will refund any payment taken for a cancelled order.
6. Shipping, delivery, and returns
Shipping options, costs, delivery estimates, and our returns policy are set out in our Shipping & Returns policy, which forms part of these Terms. Nothing in these Terms limits any non-excludable rights you have under Canadian or provincial consumer protection law.
7. Intellectual property
All content on the site — including the Night Dunes name, logos, product names, text, photography, and design — is owned by us or our licensors and is protected by intellectual property law. You may not copy, reproduce, republish, or use it for commercial purposes without our written permission.
8. Your account
If you create an account, you are responsible for keeping your login details secure and for activity that occurs under your account. Tell us promptly if you believe your account has been used without your permission.
9. Limitation of liability
To the fullest extent permitted by law, and except for any rights that cannot be excluded under applicable consumer protection law, we are not liable for indirect, incidental, or consequential losses arising from your use of the site or products. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Where our liability cannot be excluded but can be limited, it is limited to the amount you paid for the product concerned.
10. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Any dispute will be subject to the courts of that province, without affecting any mandatory consumer rights you have where you live.
11. Changes to these Terms
We may update these Terms from time to time. The version in effect when you place an order applies to that order. The “Last updated” date shows when they last changed.
